Terms of Use
"DebitWay" means DebitWay.com, its successors, and assigns. This Agreement between you, Subscriber and DebitWay governs the use, download, and storage of any DebitWay website ("Site/URL"), including the sending of any electronic mail communication into the DebitWay network, in conjunction with VeriPayment.com LTD. and Universal Payment Solutions and use of any DebitWay resources ("Service(s)" authorizing DebitWay to charge your debit card. These Services permit Subscribers to perform a number of interactive functions through the use of a personal computer.
Accepting the Agreement
When you use any of the Services described in this Agreement, or authorize others to use them, you agree to the terms and conditions of the entire Agreement.
Payment Process
DebitWay allows Subscribers to transmit data to various financial networks and telecommunication networks for settlement. In order to enroll in any DebitWay Service, you must be at least 18 years of age; you must populate every field on every form presented to you with accurate data; you must have a valid email address; and you must agree to be bound by this Agreement and/or any other agreement governing your use of the Service and/or particular resource. Your failure to populate every field may result in your waiver of certain rights under this Agreement, or other agreements.
DebitWay subscribers fully understand that an Identity Verification fee maybe included in any purchases made through every transaction processed through DebitWay.
DebitWay will request information from the user in the payment part of the registration process. Here a user must provide accurate contact information (like name and email address) and financial information (like credit card number, expiration date). This information is used for Identity Verification purposes, billing purposes and to fill customer's orders. If we have trouble processing an order, this contact information is used to get in touch with the user. However if DebitWay feels that you have provided fraudulent information in any way it may result in the immediate termination of your order.
Information Collected
DebitWay is the sole owner of the information collected on this site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. DebitWay collects information from our users at several different points.
Specifically, the information DebitWay collects online for Identification/verification and processing may includes:
- First and last name (middle initial and suffix, as applicable);
- Social Security number;
- Date of birth;
- Gender;
- Daytime and evening telephone numbers;
- Current and former mailing address;
- Credit card number, expiration date and billing address;
- Current employer and address;
- Drivers license number, state of issue.
All information collected by DebitWay is solely used to process your order, to accurately verify your identity and provide you with a Transaction ID that will confirm who you say you are to other members through the World Wide Web. DebitWay can and will only reveal any or all your information if it is requested by the law from the proper United Kingdom Authorities with legitimate documentations. (Ex: court order, subpoena, police report etc..)
Personal Information Changes
If anyone of DebitWay subscribers' personal identifiable information changes (such as your address etc.) the subscriber must immediately contact our administration department at admin@debitway.com for security and billing purposes or if a user no longer desires our service, we will endeavor to provide a way to correct, update or remove that user's personal data provided to us. This can be done by simply e-mailing your requested changes to admin@debitway.com. Every DebitWay subscriber acknowledges that lying or misrepresentation of their identity of any sort shall result in the termination of their Subscription immediately. No subscriber may represent himself or herself as another existing member at neither time nor share, rent or resell his or her Subscription to anyone at any time. The Subscriber further acknowledges that the termination of his/her subscription at any time shall in no way prevent DebitWay from pursuing other avenues of recourse such as criminal or civil proceedings.
Credit Card Authorization
By submitting your credit card ("Bank Card") data to DebitWay, you authorize DebitWay in its complete discretion to submit a financial transaction(s) to your issuing bank for settlement. You agree that once DebitWay has approved or declined your transaction, DebitWay has fully performed under the terms of this Agreement.
You agree to contact DebitWay immediately in the event that you desire to cancel any recurring charge, prior to the next billing cycle. Should you fail to contact DebitWay, you agree to indemnify and hold DebitWay harmless from any losses or damages that you suffer as a result of a recurring charge. If you think that there is an error on your account, including an incorrect amount or unauthorized transaction, you agree to contact DebitWay immediately. Upon proper notification, DebitWay, in its sole discretion may issue a credit to your Bank Card.
Authorized Payments & Refunds
DebitWay cannot be held responsible for restoring the client's credit limit upon declining an authorized payment or giving a refund. It may take up to 45 days for the client's bank to reinstate the credit limit to its original amount. Please allow for this time duration to pass before contacting DebitWay about such matters.
Refund Policy
If the customer of a merchant contacts DebitWay about a charge on their card or for a refund, DebitWay will contact the merchant and give the merchant 48-72 hours to respond to the customer. If after 72 hours, the merchant does not respond, then the customer's order will automatically queue for a refund. If the merchant does respond, then the customer will be notified by email of the response: customer and merchant can thereafter resolve the issue.Subscriber Accounts, Passwords & Security
Some interactive resources provided to you require a username and password scheme. You are responsible for maintaining the confidentiality and security of your username password, and you are fully responsible for any activity that occurs under your password or account. You agree to immediately notify DebitWay of any unauthorized use of your password or account, and ensure that you properly log-off any session that requests resources protected by secure hardware/software schemes. DebitWay shall not be liable for any loss or damages arising from your failure to comply with this section.
Subscriber Conduct
You understand that all information, data, text, software, music, sound, photographs, graphics, movies, videos, messages, or other materials, ("Content") whether publicly posted or privately transmitted, are the sole responsibility of the person from which the Content originated. This means that DebitWay is not responsible for any online activity. You understand that some of the Content may be offensive, indecent, or objectionable. Under no circumstances, will DebitWay be liable in any manner for any Content, including, but not limited to, any errors or omissions, or for any loss or damage of any kind incurred as a result of the use of any Content.
DebitWay has no obligation to monitor the Content.. However, DebitWay reserves the right to review Content and decide as to whether DebitWay is interested in the provision of Services in connection with said Content. DebitWay reserves the right to terminate your access to any or all of the Services at any time, without notice, for any reason whatsoever.
DebitWay reserves the right at all times to disclose any information as DebitWay deems necessary to satisfy any applicable law, regulation, legal process or governmental request.
Liability
DebitWay will not be liable in the following scenarios:- In the event of force majeure.
- The failure of DebitWay in conjunction with Generation Technologies central computer system or any part thereof.
- For delays, losses, errors, or omissions resulting from failure of any telecommunications or any other data transmission system.
- For any loss as a result of any act of God.
- For an outbreak of hostilities, riot, civil disturbance, acts of terrorism.
- For the acts of Government or authority (including refusal or revocation of any license or consent).
- For fire, explosion, flood, theft, malicious damage, strike, lockout, or industrial action of any kind.
